Welcome to Zen Puzzle Tales. These Terms of Service ("Terms") govern your access to and use of the Zen Puzzle Tales mobile application (the "App") provided by Zen Puzzle Tales ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated into these Terms by reference.

2. Eligibility

The App is intended for users of all ages. If you are under the age of 13 (or the minimum age of digital consent in your jurisdiction), you may use the App only with the involvement of a parent or guardian.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices that you own or control, subject to these Terms.

You agree NOT to:

• Copy, modify, distribute, or create derivative works based on the App or its content.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App for any illegal, fraudulent, or unauthorized purpose.
• Attempt to gain unauthorized access to our servers, systems, or networks.
• Use automated scripts, bots, or other means to interact with the App in unintended ways.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices within the App.

4. Game Content and Progress

The App provides puzzle gameplay featuring cultural artwork and educational content. Your game progress is associated with your device identifier and stored on our servers for synchronization purposes.

We reserve the right to:

• Add, modify, or remove game content (including levels, themes, and features) at any time.
• Modify game mechanics, difficulty settings, or scoring systems.
• Reset game progress in cases of detected abuse or system errors.

5. Intellectual Property Rights

Our Intellectual Property

The App and all its content — including but not limited to artwork, text, graphics, logos, user interface design, game mechanics, audio, and software code — are owned by us or our licensors and are protected by applicable intellectual property laws.

Cultural Artwork

The App features reproductions of historical and cultural artworks for educational purposes. These reproductions are provided under fair use or public domain principles. All rights to specific artwork designs, arrangements, and presentations within the App remain with us.

6. Disclaimers and Limitation of Liability

6.1 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APP.

7. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice. You may stop using the App at any time by uninstalling it from your device.

Effect of Termination

Upon termination:

• Your license to use the App is immediately revoked.
• We may delete your game data from our servers.
• Provisions that by their nature should survive termination (including liability limitations, intellectual property, and dispute resolution) shall remain in effect.

8. Dispute Resolution and Governing Law

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

8.2 Dispute Resolution

Any disputes arising from these Terms or the use of the App shall first be attempted to be resolved through good-faith negotiation. If unable to resolve through negotiation, disputes shall be submitted to binding arbitration.

8.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

10. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the App.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
